{"id":3995,"date":"2022-10-11T08:59:43","date_gmt":"2022-10-11T12:59:43","guid":{"rendered":"https:\/\/www.nationalpotatocouncil.org\/?p=3995"},"modified":"2022-10-11T08:59:44","modified_gmt":"2022-10-11T12:59:44","slug":"new-h-2a-regulations-published","status":"publish","type":"post","link":"https:\/\/www.nationalpotatocouncil.org\/new-h-2a-regulations-published\/","title":{"rendered":"New H-2A Regulations Published"},"content":{"rendered":"\n<p>On Oct. 6, 2022, the Department of Labor (DOL) announced the final rule, \u201c<a href=\"https:\/\/www.dol.gov\/agencies\/whd\/agriculture\/h2a\/final-rule\" target=\"_blank\" rel=\"noreferrer noopener\">Temporary Agricultural Employment of H-2A Nonimmigrants in the United States<\/a>,\u201d amending the department\u2019s regulations governing the H-2A program to increase protections for workers and streamline the process for employers.<\/p>\n\n\n\n<p>The final rule retains many of changes proposed during the Trump Administration in July 2019, designed to simplify and modernize the application process, including establishing a single point of entry for employers to electronically file Applications for Temporary Employment Certification, job orders, and all supporting documentation through a centralized DOL portal.<\/p>\n\n\n\n<p>Changes benefiting workers include revising how employers qualifying as H-2A Labor Contractors (H-2ALCs) obtain temporary labor certifications; requiring that worker housing meet applicable local, state, or federal health and safety standards; and, replacing prevailing wage survey guidelines with new standards.&nbsp;<\/p>\n\n\n\n<p>The new regulations go into effect November 14, 2022.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Oct. 6, 2022, the Department of Labor (DOL) announced the final rule, \u201cTemporary Agricultural Employment of H-2A Nonimmigrants in the United States,\u201d amending the department\u2019s regulations governing the H-2A [&hellip;]<\/p>\n","protected":false},"author":4,"featured_media":626,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"pgc_sgb_lightbox_settings":"","footnotes":""},"categories":[12,9,10],"tags":[],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v22.6 -
